These Terms and Conditions (“Terms”) govern your access to and use of the GoodnightHabits website and your purchase of personalized digital story products from GoodnightHabits.
Please read these Terms carefully before placing an order. By using our website or purchasing a Product, you agree to these Terms.

In these Terms, “GoodnightHabits,” “we,” “us,” or “our” refers to MB Joga Bonito.
2.Definitions
For purposes of these Terms:
“Website” means the GoodnightHabits website and any related pages, features, or services operated by us.
“Product” means a personalized digital bedtime story product purchased through the Website, including a personalized 7-night story pack.
“Digital Content” means the digital stories, files, text, illustrations, audio, or other digital materials provided as part of a Product.
“Customer,” “you,” or “your” means the person purchasing or using a Product.
“Personalization Information” means information submitted by the Customer for the purpose of creating a personalized Product, such as a child's first name, selected habit, story world, preferences, or other information requested during the ordering process.
“Order” means a purchase submitted through the Website.
“Business Day” means a day other than a Saturday, Sunday, or public holiday in Lithuania.
3.Our Product
GoodnightHabits provides personalized bedtime stories designed for families with young children.
Our Products are intended to:
- make bedtime more engaging
- encourage repetition of positive habits
- provide age-appropriate storytelling
- incorporate themes inspired by the Psalms; and
- create a personalized reading experience based on information provided by the Customer.
Our Products are educational and entertainment materials. They are not medical, psychological, therapeutic, or professional advice.
We do not guarantee that a child will develop, maintain, or improve any particular habit as a result of using a Product.
4.Eligibility and Use by Children
The Customer must be legally capable of entering into a purchase contract under the laws applicable to the Customer.
GoodnightHabits Products are intended to be purchased and used by parents, guardians, caregivers, or other responsible adults.
Our Products are designed for children approximately 3–6 years old, but parents and caregivers should determine whether a particular Product is appropriate for their child.
Children should not independently provide payment information or place orders through the Website.
The Customer is responsible for supervising a child's use of the Product where appropriate.
5.Ordering Process
To purchase a Product, you may be required to:
- complete the personalization questionnaire
- provide the requested information
- review your order
- provide payment information
- accept these Terms; and
- submit your order.
Before submitting an order, you are responsible for checking that all Personalization Information is accurate.
An order confirmation does not necessarily mean that the Product has already been created.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- information provided is incomplete or inappropriate
- we suspect fraudulent or unauthorized activity
- technical problems prevent fulfillment
- the requested content cannot reasonably be created; or
- required information is missing.
If we cancel an order after payment has been taken, we will refund the amount paid for that order.
6.Personalization
Our Products are created using the Personalization Information supplied by you.
You are responsible for ensuring that the information you provide is accurate.
This includes, without limitation:
- the child's name
- selected habit
- story preferences
- spelling
- email address; and
- any other information submitted during checkout.
If you enter incorrect information and the Product is created using that information, we are generally not required to provide a refund or free replacement solely because the Customer entered incorrect information.
However, if we make an error in creating the Product despite receiving correct information from you, please contact us and we will work to provide an appropriate correction or replacement.
We may make minor editorial, grammatical, formatting, or creative adjustments where reasonably necessary to produce a coherent story.
7.Price and Payment
The price of a Product will be displayed on the Website before you place your order.
Prices may be displayed in U.S. dollars or another currency depending on the Website and Customer's location.
Unless otherwise stated at checkout, applicable taxes, VAT, or similar charges may be included in or added to the displayed price as required by applicable law.
Payment must be successfully completed before we are required to create or deliver the Product.
Unless the checkout page expressly states otherwise, a Product is a one-time purchase and does not create a recurring subscription.
We may change prices for future purchases. A price change will not affect an Order that has already been accepted and paid for.
8.Delivery of Digital Content
GoodnightHabits Products are delivered digitally.
After your Order is accepted and the personalized Product has been created, we may provide access through:
- a download link
- a Website account or page; or
- another digital delivery method stated at checkout.
We aim to deliver Products within the timeframe stated on the Website or during checkout.
Because Products are personalized, creation may take longer than delivery of ordinary pre-existing digital content.
You are responsible for providing a valid email address and for ensuring that you can access the email, link, file, or other delivery method used.

We will make reasonable efforts to investigate and resolve genuine delivery problems.
9.Digital Content and Consumer Rights
GoodnightHabits provides digital content rather than physical goods.
Nothing in these Terms excludes, restricts, or limits any consumer rights that cannot legally be excluded or limited in the Customer's jurisdiction.
If the Digital Content does not conform to what was agreed, is materially defective, or is not delivered as required, the Customer may have statutory rights or remedies depending on applicable law.
For Customers located in the United States, refund and cancellation rights are generally determined by applicable federal and state law together with the refund policy disclosed at the time of purchase.
For Customers located in the European Union, European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protection laws, additional statutory rights may apply.
Where applicable law gives you a right that conflicts with these Terms, the mandatory legal right will prevail.
10.Right of Withdrawal
10.1 Customers in jurisdictions without a statutory withdrawal right
If you purchase from a jurisdiction that does not provide a statutory cooling-off or withdrawal period for this type of digital purchase, you do not receive a general right to cancel simply because you changed your mind.
In particular, once creation of your personalized Digital Content has begun, the purchase is generally non-refundable except as required by applicable law or under our Refund Policy in Section 11.
10.2 EU/EEA and other jurisdictions with mandatory withdrawal rights
If you are a consumer in a jurisdiction that provides a statutory right of withdrawal, that right will apply unless a lawful exception applies.
For digital content that is not supplied on a tangible medium, EU consumer law provides an exception to the right of withdrawal where the required conditions are satisfied, including that:
- you expressly consent to the performance beginning during the withdrawal period
- you acknowledge that you lose your right of withdrawal when performance begins; and
- the required confirmation is provided.
These requirements are particularly relevant to personalized Digital Content supplied immediately after purchase.
Where required, we will obtain the applicable consent and acknowledgement through the checkout process.
If the required legal conditions for an exception are not satisfied, we will respect the applicable statutory withdrawal right.
11.Refunds and Customer Support
11.1 General refund policy
Because GoodnightHabits Products are personalized digital content created specifically using information provided by the Customer, purchases are generally non-refundable once personalization or creation of the Product has begun, except where a refund is required by applicable law.
We do not offer refunds merely because a Customer changes their mind after personalization or creation has begun.
This includes situations where:
- the child does not enjoy the story
- the child loses interest
- the child does not engage with the story
- the child does not develop the selected habit
- the Customer no longer wants the Product
- the Customer expected a different creative style
- the Customer forgot that they placed the Order
- the Customer entered preferences they later changed their mind about
- the Customer expected the Product to guarantee a behavioral result; or
- the Customer purchased the Product but subsequently decides not to use it.
11.2 When we will provide a remedy
We will review requests for a refund, replacement, or other appropriate remedy where:
- the Product was not delivered
- the delivered Product is materially defective or corrupted
- the Product is materially different from what was advertised or purchased
- we used materially incorrect Personalization Information despite receiving correct information from the Customer
- a technical problem caused the Customer to receive unusable Digital Content; or
- applicable law requires a refund or other remedy.
Where appropriate, our first remedy may be to correct or replace the Product.
If a replacement or correction reasonably resolves the problem, a refund may not be necessary unless required by applicable law.
11.3 Refund requests

We may request reasonable information necessary to verify an Order and investigate a technical or fulfillment issue.
11.4 Fraudulent or abusive refund activity
We reserve the right to investigate refund requests and payment disputes where we reasonably suspect fraud, unauthorized use, duplicate claims, misuse of our refund policy, or other abusive activity.
Nothing in this section limits any rights the Customer has under applicable law.
12.Intellectual Property
All intellectual property rights in the Website, GoodnightHabits branding, original story frameworks, templates, designs, text, graphics, software, and other materials provided by GoodnightHabits belong to us or our licensors unless otherwise stated.
When you purchase a Product, you receive a limited, personal, non-exclusive, non-transferable right to use the purchased Digital Content for personal, non-commercial family use.
You may:
- read the stories to your child
- download the Product where downloading is provided
- print the Product for personal family use where technically permitted; and
- share the Product within your immediate household for personal use.
You may not, without our prior written permission:
- resell the Product
- commercially distribute the Product
- upload the Product to public websites or file-sharing services
- reproduce the Product for commercial purposes
- remove proprietary notices
- use the Product to create a competing commercial product
- distribute personalized stories to customers or third parties as a commercial service; or
- copy or reproduce our underlying story frameworks, systems, templates, or proprietary materials.
13.Customer-Provided Content
You may provide Personalization Information and other information to us for the purpose of creating your Product.
You represent that you have the right to provide any information or content you submit.
You grant GoodnightHabits a limited right to use, process, reproduce, and modify information you provide solely as reasonably necessary to:
- create your Product
- deliver your Product
- provide customer support
- operate and improve our services; and
- comply with legal obligations.
We do not acquire ownership of your personal information merely because you provide it to us.
Our handling of personal information is governed by our Privacy Policy.
14.AI and Content Creation
GoodnightHabits may use automated technologies, including artificial intelligence (“AI”), in some parts of the content creation process.
AI may be used to assist with:
- story generation
- editing
- personalization
- formatting
- illustrations
- quality control; or
- other creative or operational processes.
Where AI is used, we may review, edit, modify, or otherwise process generated content before delivery.
Because creative generation involves automated systems, individual Products may contain minor stylistic variations, imperfections, or differences from examples shown on the Website.
We aim to provide Products that are appropriate for the intended audience and consistent with the Product description, but we do not guarantee that every creative element will be identical to examples displayed on the Website.
15.Third-Party Services
We may use third-party providers to operate parts of the Website or deliver our Products, including providers of:
- payment processing
- hosting
- email delivery
- analytics
- content generation
- file storage
- customer support; and
- other technical services.
Third-party services may have their own terms and privacy policies.

However, we do not guarantee any particular behavioral, educational, developmental, emotional, or other outcome.
In particular, we do not guarantee that a child will:
- adopt a particular habit
- stop resisting a particular activity
- eat a particular food
- brush their teeth more consistently
- go to bed more easily
- share more frequently
- behave differently; or
- respond positively to the stories.
Children respond differently to stories, routines, parenting techniques, and educational materials.
The Product is intended as a supportive tool and is not a substitute for parental supervision, professional advice, or appropriate medical or psychological care.
18.Limitation of Liability
To the maximum extent permitted by applicable law, GoodnightHabits will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Website or Product.
This may include, to the extent permitted by law, loss of profits, loss of data, loss of business opportunities, or other indirect losses.
Our total liability arising from a particular Product or Order will not exceed the amount you actually paid for that Product, except where a greater amount is required by applicable law.
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation
- death or personal injury caused by negligence where such exclusion is prohibited
- intentional misconduct where such exclusion is prohibited; or
- any other liability that cannot legally be excluded or limited.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, the limitations above will apply only to the maximum extent permitted by law.

These Terms are governed by the laws of the Republic of Lithuania, except to the extent that mandatory consumer protection laws in the Customer's jurisdiction provide otherwise.
If you are a consumer, nothing in this section deprives you of mandatory rights or protections available under the laws that apply to your consumer contract.
Any dispute that cannot be resolved directly between the Customer and GoodnightHabits will be handled by the courts or other dispute-resolution bodies having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to waive mandatory rights to bring a claim in a court or forum that applicable law makes available to that consumer.
26.Force Majeure
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control.
Such circumstances may include:
- natural disasters
- war
- terrorism
- government action
- widespread internet or telecommunications failures
- cyberattacks
- infrastructure failures
- payment-provider failures
- hosting-provider failures
- labor disputes; or
- other events outside our reasonable control.
Where reasonably possible, we will take steps to minimize the impact of such events.
27.Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law.
The remaining provisions will continue in full force and effect.
28.Entire Agreement
These Terms, together with the applicable Privacy Policy, Refund Policy, and information presented during checkout, constitute the agreement between you and GoodnightHabits concerning your use of the Website and purchase of Products.
If there is a conflict between these Terms and mandatory applicable law, the mandatory law will prevail.
If there is a conflict between these Terms and a specific written agreement expressly entered into between you and GoodnightHabits, the specific agreement will prevail to the extent of the conflict.
